IN THE NEWS: Attorney Jamie Sheller Quoted by Business Insurance on Data Breach Issues

2011-06-09 - PHILADELPHIA—Cyber liability plaintiffs are experiencing more success in the courts, significantly increasing potential costs for companies that have experienced data breaches . . . Jamie L. Sheller, principal at Sheller P.C. in Philadelphia, said plaintiff attorneys have gotten more adept at moving cyber liability cases beyond motions to dismiss to the discovery stage. Ms. Sheller noted that the first mistake many companies make following a data breach “is to downplay the breach.” Because of regulations in most states requiring companies to disclose exposure of consumer information, the information will become public, she noted, and the initial denials will cause greater reputational damage. __Click icon for full story__

NEWS: Attorney Stephen Sheller files suit claiming Philly cops use 'live stop' statute to seize cars illegally

2011-03-31 - After Philly police confiscate car under "live-stop" statute, Sheller sues. Danielle Sheller planned to spend last Friday afternoon with her fiance at a West Philadelphia florist, looking at flowers for their wedding. Instead, on the way, police pulled Sheller over, citing an expired registration for the car she was driving. The officers immediately had the car towed and impounded under the city's "live-stop" statute, aimed at keeping illegal drivers off the streets. Then, according to Sheller, the police drove off, leaving Sheller and her fiancé on the corner of 58th Street and Woodland Avenue. Sheller's father, Center City lawyer Stephen Sheller, who owns the car, didn't think it was all that funny. He and his daughter are suing the Police Department and the Parking Authority, arguing that the officers violated the department's rules when they left the couple on the street. The lawsuit, filed this week in Common Pleas Court, also alleges that the live-stop law is unconstitutional. Sheller and his daughter are seeking an injunction against the law, as well as restitution and damages for themselves and others whose cars have been towed under the statute.

NEWS: Sheller Attorneys Win Class Cert. in 'Light' Tobacco, Potential Actual Damages of Billions for Consumers in Minnesota

2010-12-28 - Attorneys Stephen Sheller and Martha Wivell represent plaintiffs in a class action lawsuit certified by the Minnesota Court of Appeals alleging that Philip Morris defrauded smokers of Marlboro Light cigarettes in that state. Filed in 2001, the class action could open the door to actual damages of total purchases in the billions of dollars for smokers who bought the cigarettes in the state between 1972 and 2004. The potential recovery of purchase price could be tens of thousands per smoker. “This could be the largest fraud perpetrated on consumers in the United States, even bigger than Madoff” says Sheller, once actual and punitive damages are determined. Although it's not yet time to contact attorneys and join the class action, smokers in Minnesota are encouraged to gather records of Marlboro Lights cigarette purchases from 1972-2004. Return to Sheller.com for more information as litigation progresses. For commentary and debate from Attorney Stephen Sheller on 'Light' tobacco litigation and class action certification, see video (being updated as the story continues to develop).
